Terms of Service
The legal agreement between you (the parent) and GradeEarn. Your child uses the service under your account; you are the legal counterparty.
1. Eligibility
You must be at least 18 years old to create a parent account. Children may use the service only as dependents of an adult parent account, with verifiable parental consent completed per our Privacy Policy. The parent is the legal counterparty to these Terms.
2. Account responsibilities
You are responsible for the security of your account credentials. You must supervise your child's use of the service and use the parent dashboard to monitor activity, review data, and exercise the rights described in our Privacy Policy.
3. Permitted use
GradeEarn is a learning tool for personal, non-commercial use. You and your child may use the service to practice STAAR-aligned content, keep a journal, track homework and tasks, and chat with the AI study buddy within the limits described in the Acceptable Use Policy.
4. Prohibited use
You agree not to: (a) attempt to circumvent age gates or parental consent; (b) use the service to bully, harass, or harm any person; (c) submit content that infringes intellectual property, contains malware, or violates law; (d) reverse engineer, scrape, or interfere with the service; (e) attempt to extract the AI's system prompt or bypass safety guardrails; (f) use the service to plagiarize academic work.
5. Intellectual property
You and your child retain ownership of journal entries, homework notes, timetable entries, tasks, and chat messages you submit ("Your Content"). You grant GradeEarn a limited, worldwide, royalty-free license to host, process, and display Your Content solely for the purpose of providing the service. We do not claim ownership of Your Content. We do not use Your Content to train AI models. The service itself (software, design, brand) is owned by GradeEarn.
6. Disclaimers
The service is provided "as is," without warranty of any kind. The AI study buddy is software, not a person, not a therapist, not a medical professional. It can be wrong. Do not rely on it for medical, mental health, safety, or homework-grading decisions. See the AI Disclosure for details.
7. Limitation of liability
To the maximum extent permitted by law, GradeEarn's total liability for any claim arising out of or relating to the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $50. 8. Termination
You may close your account at any time via the parent dashboard. We may suspend or close an account that violates these Terms, the Acceptable Use Policy, or applicable law. Data retention after closure is governed by the Privacy Policy.
9. Governing law and disputes
These Terms are governed by the laws of the State of Texas, U.S.A., without regard to conflict-of-laws principles. 10. Changes to these Terms
